Archives and the Right to Erasure: The Mission of Memory in trend of Privacy

Abstract

Right to Erasure evolved from the Right to be Forgotten, a right that has significant implications for archival work. The Right to be Forgotten is part of privacy protection laws under the General Data Protection Regulation (GDPR) — known in Thailand as the Personal Data Protection Act (PDPA). Under this right, data subjects may request data controllers to delete personal data that adversely affects their lives, such as criminal records. However, archival documents often contain personal information as part of the evidence generated from governmental operations. Consequently, the enforcement of the Right to be Forgotten could lead to content discontinuity, damage to documentary interpretation, and information gaps, since the archival mission—to preserve memory—fundamentally conflicts with the essence of this right. A comparison between GDPR Article 17 and the Thai PDPA reveals that, in Thailand, the Right to Erasure does not have as severe an impact on archival institutions. Nevertheless, organizations should establish clear policies and operational guidelines to manage potential legal risks that may arise from the implementation of this right.
