Abstract

 This research article aimed 1) study of The Enforcement condition about Communicable disease law by focus on Communicable Diseases Act, B.E. 2558 2) Comparative of laws about Communicable disease law of Thailand against Malaysia, Singapore and Vietnam 3) guideline about Communicable disease law that appropriate for Thailand


The research finding


1) The Enforcement condition of Communicable Diseases Act, B.E. 2558 which aims to prevent and control disease There are four study issues, viz: (1) penalty for violation or non-compliance with orders of communicable disease control measure under section 34 which are generally aimed at disease prevention and control as well, do not respond the purposes of the law from the imposition of penalties are divided into section 51 and section 52. (2) The nature of enforcement measures in each area, It appears that local measures must be set for each part differently. (3) Repeat offenses for offenses related to communicable diseases do not have specific penalties. (4) Penalties for those who spread the disease are not expressly stated.


2) The comparison of legal find that the penalty for violation or non-compliance with orders of communicable disease ,It usually appears in the form of a  general penalty : single base. The nature of enforcement measures, it's often has a standard to affect nationwide. Repeat offenses Recidivism may appear as a specific pattern in communicable disease laws. and Specific penalties for spreaders of the disease are clearly imposed.


3) Guidelines for imposing penalties for violating or failing to comply with orders of communicable disease officers as general penalties and Interpolate standards of enforcing measures for nationwide. In addition, additional penalties for specific recidivism shall be imposed and imposing, make actions that risk spreading disease an offense.
