The Preparation of Minitry of Justice's Agencies for the Establishment of Courts of First Instance in the Office of Judiciary

Abstract

The purpose of this research was to study and analyze the circumstances and problem issues concerning Ministry of Justice agencies' preparation for the Establishment of Courts of First Instance in the Office of Judiciary. This study dalso aimed to propose the appropriate integrated ways to coordinate the overall operation plan in establishing the Court of First Instance between the ministry of Justsice agencies and the Office of Judiciary in the future.

The problem analysis from statistics, legal, documentary and in-depth interviews of representatives from relating justice system agencies revealed that most of agencies in Ministry of Justice have some common problems, particularly the deficiencies of land resource for the preparation of establishing the office building, personnel, human resources allocation and budget. According to the problem findings, the author would like to propose three solutions as follows : 1) the Office of Judiciary should propose the plan for establishing the first instance court to the National Justice Commission for its recommendations to the cabinet 2) Assigning Dhanarak Asset Development Company Limited to provide land resource, office buildings and all required materials for justice system agencies 3) Building awareness on resource deficiencies to the government  agencies which are responsible for the overall budgetary and human resource, for example, Bureau of the Budget, Office of the Civil Service Commission and Office of the Public Sector Development Commission, to analyze and allocate the integrate budget.
