กรอบแนวทางการเปิดเผยข้อมูลประวัติอาชญากรรมของเยาวชนในการจ้างงานภาคเอกชน: ความท้าทายในกระบวนการยุติธรรมและข้อเสนอเชิงนโยบาย

บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาวิเคราะห์ประเด็นปัญหาและข้อจำกัดในการเปิดเผยข้อมูลประวัติอาชญากรรมของเยาวชนที่เคยกระทำผิดในคดีอาญา ทั้งในมิติทางกฎหมายและนโยบายที่ส่งผลต่อโอกาสในการเข้าสู่ตลาดแรงงาน และ (2) ออกแบบกรอบแนวทางการเปิดเผยข้อมูลที่สมดุลระหว่างการคุ้มครองสิทธิของเยาวชนกับความต้องการของภาคธุรกิจ งานวิจัยนี้ดำเนินการภายใต้ระเบียบวิธีวิจัยเชิงคุณภาพ โดยอาศัยการเก็บข้อมูลผ่านการสัมภาษณ์เชิงลึก การสนทนากลุ่ม จากผู้มีส่วนเกี่ยวข้องในภาครัฐ ภาคเอกชน รวมถึงเยาวชนผู้เคยกระทำความผิด ผลการศึกษาชี้ให้เห็นถึงความไม่ชัดเจนทางกฎหมาย การปฏิบัติงานขาดมาตรฐาน รวมทั้งผลกระทบระยะยาวต่อโอกาสในการจ้างงานโดยเฉพาะในภาคเอกชนซึ่งใช้ข้อมูลจากทะเบียนประวัติอาชญากรโดยขาดหลักเกณฑ์การเปิดเผยอย่างเหมาะสม อันเป็นอุปสรรคสำคัญต่อการฟื้นฟู ตลอดจนการคืนคนดีสู่สังคมอย่างแท้จริง ผู้วิจัยจึงเสนอกรอบแนวทางโดยเน้นการจำแนกประเภทข้อมูล การคุ้มครองข้อมูลส่วนบุคคล พร้อมทั้งการสร้างกลไกความร่วมมือระหว่างรัฐกับเอกชน รวมถึงข้อเสนอแนะเชิงนโยบายเกี่ยวกับการจัดตั้งทะเบียนผู้กระทำผิดของเยาวชนแยกจากทะเบียนผู้ใหญ่ การทบทวนแนวทางการพิมพ์ลายนิ้วมือ การเพิ่มเติมบทบัญญัติว่าด้วยการไม่เลือกปฏิบัติในกฎหมายแรงงาน การส่งเสริมการจ้างงานที่เหมาะสม เพื่อสร้างระบบเป็นธรรม มีความสมดุล อันสอดคล้องกับหลักสิทธิตามอนุสัญญาว่าด้วยสิทธิเด็กของสหประชาชาติ
