Abstract

PURPOSES: To analyze the Act on Establishment of Government Organizations B.E. 2496 and a number of state agencies which are neither government organizations nor state enterprises that are established by virtue of the aforementioned Act with their objectives of conducting non-profit businesses solely. METHODS: Documentary research and critical analysis. RESULTS: The study has revealed that some state agencies are established by virtue of this Act as state enterprises regardless of the fact that some of these state agencies do not fall into the criteria of government sectors as these entities are not subject to government sectors in terms of their internal organizational management and neither do they fall into the criteria of state enterprises as their objectives are limited to the provision of public services through non-industrial or non-commercial activities only. CONCLUSIONS: The said organizations would better not be defined as state enterprises. They should rather be regarded as public organizations.
