บทวิเคราะห์บทบาทของ กสทช. ในการออกระเบียบข้อบังคับการถ่ายทอด รายการกีฬาทางโทรทัศน์ในประเทศไทย

วัตถุประสงค์ เพื่อวิเคราะห์อำนาจหน้าที่ของ กสทช. ในการออกระเบียบข้อบังคับเกี่ยวกับการเผยแพร่การถ่ายทอดรายการกีฬาในกิจการทางโทรทัศน์ในประเทศไทย เปรียบเทียบกับแนวทางในต่างประเทศ และเสนอแนวทางปรับปรุงระเบียบข้อบังคับที่เหมาะสมกับบริบทประเทศไทย วิธีการศึกษา ใช้วิธีการศึกษาเชิงเอกสารและการวิเคราะห์ระเบียบข้อบังคับของ กสทช. กรณีการถ่ายทอดรายการกีฬา โดยเฉพาะการแข่งขันฟุตบอลโลก รวมทั้งศึกษาระเบียบและแนวปฏิบัติในต่างประเทศเพื่อนำมาเปรียบเทียบ ผลการศึกษา ระเบียบข้อบังคับของ กสทช. ส่งผลกระทบต่อผู้ประกอบกิจการโทรทัศน์อย่างมีนัยสำคัญ และก่อให้เกิดปัญหาทางกฎหมายหลายประการ ได้แก่ ความไม่ชัดเจนของข้อบังคับ ความไม่สอดคล้องกับสภาพตลาด และความแตกต่างจากแนวปฏิบัติในต่างประเทศ รวมทั้งก่อให้เกิดข้อขัดแย้งด้านลิขสิทธิและการแข่งขันทางธุรกิจ นัยทางทฤษฎี/นโยบาย ทบทวนและปรับปรุงระเบียบข้อบังคับ โดยพิจารณามาตรการทางเลือกที่เหมาะสม เพื่อส่งเสริมการคุ้มครองสิทธิประชาชน การแข่งขันที่เป็นธรรม และการพัฒนาตลาดการถ่ายทอดรายการกีฬาทางโทรทัศน์ในประเทศไทย
