การมีส่วนร่วมของชุมชนในกระบวนการยุติธรรมเชิงสมานฉันท์ทางอาญาของไทย

Abstract

บทคัดย่อ

          วัตถุประสงค์ของการวิจัยนี้ ได้แก่ ศึกษาลักษณะสำคัญทางวิชาการและปฏิบัติ กระบวนการมีส่วนร่วมของชุมชน และแนวทางการพัฒนาการมีส่วนร่วมของชุมชนในกระบวนการยุติธรรมเชิงสมานฉันฑ์ทางอาญาของไทย ด้วยวิธีการวิจัยจากเอกสาร การสัมภาษณ์แบบเจาะลึก และการประชุมระดมสมอง ผลการวิจัยสรุปได้ดังนี้

          การมีส่วนร่วมของชุมชน  คือ กระบวนการดำเนินกิจกรรมของชุมชนในการปฏิบัติภารกิจการอำนวยความยุติธรรม ได้แก่ การป้องกันควบคุมอาชญากรรม จัดการความขัดแย้ง การลดและเยียวยาความเสียหายหรือความรุนแรงที่เกิดจากอาชญากรรมหรือการกระทำผิด การเสริมพลังและการรับผู้กระทำผิดกลับคืนสู่ชุมชนด้วย ซึ่งอาศัยความเป็นปึกแผ่นทางสังคมและกฎหมายเป็นเครื่องมือรองรับกระบวนการยุติธรรมชุมชนที่เกิดขึ้นจากชุมชนร่วมคิด ร่วมตัดสินใจ ร่วมปฏิบัติ ร่วมติดตาม และร่วมรับประโยชน์ โดยชุมชนดำเนินการกันเองหรือร่วมกับหน่วยงานภาครัฐในกระบวนการยุติธรรมก็ได้ อันเป็นการเปิดโอกาสให้ชุมชนสามารถเข้าถึงความยุติธรรมในการป้องกันและแก้ไขปัญหาอาชญากรรม หรือความไร้ระเบียบใด ๆ ที่เกิดขึ้นในชุมชน เพื่อสร้างภูมิคุ้มกันและความปลอดภัย ความเป็นธรรม ความสงบสุข และคุณภาพชีวิตที่ดีขึ้นของชุมชนอย่างยั่งยืน

          การสร้างกระบวนการมีส่วนร่วมของชุมชนนั้น สามารถนำไปปรับใช้ทางปฏิบัติได้ทุกขั้นตอนของกระบวนการยุติธรรมไทย ไม่ว่าจะเป็นช่วงก่อนเข้าสู่กระบวนการยุติธรรม หรือภายหลังเข้าสู่กระบวนการยุติธรรมแล้วก็ตาม ได้แก่ ขั้นตอนก่อนฟ้องคดี ระหว่างการพิจารณาคดี หรือหลังมีคำพิพากษา

          การพัฒนาการมีส่วนร่วมของชุมชนในกระบวนการยุติธรรมเชิงสมานฉันท์ของไทยนั้น ควรมีทิศทางการพัฒนาระบบงานยุติธรรมแห่งอนาคต ทั้งในเชิงยุทธศาสตร์ โดยการแถลงนโยบายต่อรัฐสภาและกำหนดเป็นแผนนโยบายแม่บทแห่งชาติ ส่วนในเชิงกลยุทธ์ โดยการส่งเสริมและสนับสนุนกระบวนการทำงานอย่างเป็นระบบในเชิงรุกและเชิงรับ เพื่อป้องกันและแก้ไขอาชญากรรม เยียวยาและลดความขัดแย้งที่เกิดขึ้นในชุมชนอย่างยั่งยืนและเป็นรูปธรรม

Abstract

          The main objectives of this research were to study main characteristics and practices, community participation process, and the development of guideline for community participation in restorative justice of Thai crime. Documentary research, in-depth interview, and brainstorming approaches were adopted as main research approaches. Main research results were: Community participation was a process whereby community actions provided justice. These actions included the prevention and control of crime, conflict management, decreases in violence and remedies for damages stemming from committing crimes or offences, empowerment and reestablishment of the wrong doers to the community. All of these actions depended on social harmony and using the law as a tool to facilitate the community justice participation process. The community justice process was a result of community participation in cogitation, decision making, practice, follow up, and benefit sharing.  Communities could carried out those activities themselves or in conjunction with government agencies in the justice process.  This opened opportunities for communities to access justice through preventing and correcting crime problems or any disorder in the community. Protection, security, justice, peace, and a better quality of life in the community could accordingly be obtained in a sustainable manner.

            The creation of a community participation process could be practically adapted in all steps of the Thai justice process, whether prior to or after an entry into the justice process. This included prior to prosecution, during trials, or after judgments had been rendered. The development of the community participation process in the Thai justice process would indicate a direction for the future development of the restorative justice system.  This could be in the aspect of tactics through announcing this policy to the parliament and formulating a master policy. In the aspect of strategies, systematic work could be encouraged and supported in a proactive and receptive manner.  This could prevent and solve problems of crime, remedies and reduce the occurrence of conflicts in the community in a sustainable and concrete manner.
