การศึกษาการบริหารเปรียบเทียบบทบาทผู้พิพากษาสมทบในศาลเยาวชนและครอบครัว

Abstract

การวิจัยโดยใช้หลัก POSDCORB มาวิเคราะห์บทบาทและหน้าที่ของผู้พิพากษาสมทบโดยวิธีการวิจัยเชิงคุณภาพ ก่อนและหลัง พรบ. ศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ. 2553 ผลการวิจัยพบว่า ผู้พิพากษาสมทบ มีการวางแผน และออกแบบแผนงานในด้านการปฏิบัติหน้าที่ การจัดการองค์การมีการแบ่งกลุ่มภารกิจ การสรรหาบุคลากร ได้มีการกำหนดคุณลักษณะของผู้พิพากษาสมทบ การอำนวยการเป็นผู้ทำหน้าที่กำกับและติดตามให้เป็นไปตามคำพิพากษา การประสานงาน เป็นผู้ประสานงานเพื่อให้เกิดผลสำเร็จ และการจัดสรรงบประมาณให้สามารถขับเคลื่อนการดำเนินงานตามแผนได้ อย่างไรก็ดี หน้าที่รับผิดชอบของผู้พิพากษาสมทบตั้งแต่อดีตถึงปัจจุบันเปลี่ยนไปตามสถานการณ์บ้านเมือง และสภาพปัญหาที่วิกฤตขึ้น คุณลักษณะของผู้พิพากษาสมทบต้องมีวุฒิภาวะมากขึ้น มีประสบการณ์ และเข้าใจความรู้สึก ความคิดของเด็กและเยาวชนในปัจจุบันให้สมตามเจตนารมณ์ของศาลเยาวชนและครอบครัว  

This research applied POSDCORB principles of public administration to analyse status and role of Associate Judges in the Juvenile and Family Court by means of a qualitative research approach before and after the Juvenile and Family Court and Judicial Examination and Determination Act B.E. 2553. It was revered that the principles of public administration were put to action by Associate Judges as follows: planning and programming for implementation, organization of various duties and functions, recruitment of qualified Associate Judges, directing for appropriate monitoring of the verdicts, coordinating so that the verdicts were enforced effectively, and preparation of annual budget for successful implementation of plans and activities. However, roles of Associate Judges changed over time due to changes in political and other related issues that became more critical. Therefore Associate Judges have to be more qualified, e.g, more maturity, experienced and understanding of feeling and thought of youths at present time in order to fulfill the aspiration of the Juvenile and Family Court
