Enforcement of the Liquor Act A.D.1990 : The Case Study of Manufacturing SATO Local Liquor in Nakhon sawan Province

Abstract

This purpose of this research is to study problems, causes of problems, solutions, and concrete practice guidelines for the enforcement of the Liquor Act B.E. 2493 for a case study on production of SATO indigenous liquor. It was qualitative researches have key informants were citizens, agricultural officers, excise office officers obtained by purposive sampling. The research tool was In-depth individual interview with content analysis. The study results found that, firstly, the problems and the causes of the problems: It was found that there were a problem of lawlessness due to the smuggling of production of SATO indigenous liquor or holding a traditional event that was traditionally held with permission from local authorities to reduce costs, a problem of preserving local wisdom of SATO indigenous liquor, which is an indigenous brewed beverage with its geographically disappearing distinctive taste and smell production, a problem of the local liquor market compared to the local liquor market of foreign countries, which can generate a large amount of income for the country, a problem of the state inequality banning the local brewed beverage, but supporting the liquor factory and foreign beverages for taxation. Secondly, the law should be amended: It was found that, with Section 5 of the Liquor Act B.E. 2493, the Ministerial Regulation was issued for the production of SATO indigenous liquor for household use, amending the Notification of the Excise Department on the criteria, methods, and conditions for permission to produce and sell spirit beverages, indigenous brewed beverages, and liquor other than beer. For B.E. 2546 Article 3, indigenous liquor can be produced for household use, and Article 6, 16, 18, exceptions are determined in the case of the production of indigenous liquor for household use. Lastly, concrete practical guidelines: It was found that citizens producing indigenous liquor for sale must strictly comply with the law. In the case of the production of indigenous liquor for household use, the state does not allow it yet. Officers should be flexible to law enforcement. Governments should have a policy to preserve the geographically specific flavored indigenous liquor. Marketing should be developed and indigenous beverage drinking values should be created to reduce costs and generate income for the community.
