รัฐ นโยบายสาธารณะ กับการชุมนุมทางการเมืองต่อต้านรัฐบาลพลเอกประยุทธ์

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์ศึกษาการชุมนุมประท้วงรัฐบาลพลเอกประยุทธ์ และผลที่เกิดขึ้นจากการชุมนุม มุ่งเน้นในห้วงเวลาที่การเคลื่อนไหวเข้มข้นระหว่าง พ.ศ.2563-2564 งานวิจัยมีสมมติฐานว่า ภายใต้การชุมนุมรัฐบาลใช้การบังคับใช้กฎหมายกับการชุมนุมสาธารณะ อันเป็นการนำนโยบายด้านการควบคุม บังคับ ไปปฏิบัติตามปกติในมุมมองของรัฐบาล ในขณะที่ยังคงสภาวะเดิม ได้แก่ชะลอการเปลี่ยนแปลงข้อกฎหมายที่กลุ่มชุมนุมเรียกร้อง และคงอำนาจของการเป็นรัฐบาลไว้ได้ งานวิจัยใช้แนวคิดด้านการนำนโยบายไปปฏิบัติ เช่น การใช้ดุลพินิจของเจ้าหน้าที่ผู้ปฏิบัติงาน ประกอบการอภิปรายทดสอบสมมติฐาน วิธีการศึกษาใช้การวิเคราะห์ข้อมูลเอกสาร ในรูปของรายงานข่าวเกี่ยวกับข้อเท็จจริงที่เกิดขึ้นในเหตุการณ์ชุมนุม และรายละเอียดของกฎหมายที่บังคับใช้กับการชุมนุม เช่น พระราชบัญญัติที่มีการบังคับใช้กับการชุมนุมสาธารณะ และการสัมภาษณ์ผู้เกี่ยวข้องกับการชุมนุม โดยฉพาะเจ้าหน้าที่ผู้ดูแลการชุมนุม บทความได้วิเคราะห์อภิปรายรายละเอียดของการบังคับใช้กฎหมาย เพื่อตอบสนองการชุมนุมประท้วง เช่น พ.ร.ก. การบริหารราชการในสถานการณ์ฉุกเฉิน พ.ศ.2548 การแบ่งแยกอำนาจ และถ่วงดุล ตรวจสอบระหว่างหน่วยงานของรัฐ ภายใต้การบังคับใช้กฎหมาย และได้ถกแถลงถึงการคงกฎหมายเดิม โดยเฉพาะบางสาระสำคัญของรัฐธรรมนูญ 2560 และการคงอยู่ในอำนาจของรัฐบาลประยุทธ์ ในขณะที่พบคำพิพากษาของหน่วยงานตุลาการภายในกระบวนการทางคดีความ ที่เป็นทั้งคุณและโทษ แก่ทั้งฝ่ายรัฐบาลและฝ่ายกลุ่มชุมนุม
