ปัญหาการขอคืนสัญญาค้ำประกันการจัดทำสาธารณูปโภคของโครงการอสังหาริมทรัพย์

บทคัดย่อ
บริษัทพัฒนาอสังหาริมทรัพย์มักพบปัญหาการส่งมอบสาธารณูปโภคและการทำเรื่องขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภค ส่งผลให้บริษัทไม่สามารถขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภคได้ตามกำหนด งานวิจัยนี้มีวัตถุประสงค์ดังนี้ 1) เพื่อศึกษาปัญหาการขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภคของบริษัทพัฒนาอสังหาริมทรัพย์ที่ทำโครงการจัดสรรที่ดินในพื้นที่จังหวัดกรุงเทพมหานครและจังหวัดนนทบุรี 2) เพื่อวิเคราะห์ความคิดเห็นของผู้ตอบแบบสอบถามต่อปัญหาการขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภค 3) เพื่อพัฒนาแนวทางในการปรับปรุงขั้นตอนในการขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภคของบริษัทพัฒนาอสังหาริมทรัพย์ การวิจัยเป็นการศึกษาทั้งเชิงปริมาณและเชิงคุณภาพ โดยทำการเก็บข้อมูลจากกลุ่มตัวอย่าง ซึ่งเป็นผู้มายื่นขออนุญาตจัดสรรที่ดินและคณะกรรมการตรวจไถ่ถอนสาธารณูปโภคจำนวน 126 คน ด้วยเครื่องมือแบบสอบถาม นอกจากนี้การรวบรวมข้อมูลได้มีการสัมภาษณ์ผู้เชี่ยวชาญจำนวน 6 คน ซึ่งเป็นผู้ที่มีประสบการณ์ในการทำงานด้านการขออนุญาตจัดสรรที่ดินไม่ต่ำกว่า 5 ปี ผลการศึกษาพบว่าการขอคืนหนังสือสัญญาค้ำประกันการจัดทำสาธารณูปโภคมีปัญหาอยู่ในระดับปานกลางถึงมาก และประเด็นตำแหน่งงานของผู้ตอบแบบสอบถามมีความคิดเห็นแตกต่างกันมากกว่าประเด็นประสบการณ์ทำงาน สุดท้ายงานวิจัยนี้ได้เสนอแนวทางการแก้ไข เพื่อเป็นการลดต้นทุนและระยะเวลาในการดำเนินงานของโครงการ
