Hermeneutics Theory and Interpretation of Law

Abstract

Interpretation is necessary for human beings because languages for communication
are used by human beings. Notwithstanding, for many times, human beings understand
each other in different ways. This causes problems between them. Therefore, it has
questions linking to ways of thinking. Theory of interpretation for the whole picture may
be relied on Hermeneutics Theory which is the fundamental of interpretation principles
composed of many theories i.e. Language as Picture of the World and Language Games.
Notwithstanding, various society quests still do not decrease owing to human beings
understanding in differential ways of thinking in order for monitoring each other in
societies which we call “Law” that not understanding in the same way. Therefore, it needs
for the particular interpretation of the field. That is Interpretation of Law in order to
understand the meaning of text and the intention of such law in the same way. Therefore,
it is necessary for laying down the principle of the written law by ways of the above
mention theories and the particular theory in law; for example, Subjective Theory and
Objective Theory before understanding laws by considering the interpretation of letters
which can find out from the definition of such law or consider from technical terms or
search from dictionaries or meanings in foreign languages and interpret from the intention
of the meaning under names or the remark or the objective or the exception from
general principles of such law. All of the above mention are relied on Hermeneutics
Theory for the scope of the interpretation. Not only the objectives of the interpretation,
the issues of the interpretation, the interpretator but also for the acknowledgement of the
actual meaning of the intention of the law.
