Abstract
Tobacco Plain Packaging is the legal measure enforced by government in order to reduce consumers’ incentive. Such policy has been first launched by Australia, which adopted from article 11 of WHO Framework Convention on Tobacco Control. The restriction of using trademarks, however, affects trademarks owner in many aspects. This article analyses legal issues regarding plain packaging possibly used in Thailand in the future especially the right of the owner and the subordinate legislation. This paper could be useful for the revision of the draft of the Tobacco Products Control Act.
