วิเคราะห์ประเด็นเกี่ยวกับกฎหมายกรณีการใช้ “มาตรการซองบุหรี่แบบเรียบ” ในการควบคุมผลิตภัณฑ์ยาสูบในประเทศไทย

บทคัดย่อ
มาตรการบุหรี่แบบซองเรียบเป็นมาตรการที่รัฐกำหนดรูปแบบบรรจุภัณฑ์ยาสูบและห้ามใช้เครื่องหมายการค้าเพื่อเป็นการลดแรงจูงใจของผู้บริโภค โดยมาตรการดังกล่าวออสเตรเลียเป็นประเทศแรกที่นำมาใช้โดยนโยบายนี้สอดคล้องกับ Article 11 ของกรอบอนุสัญญาว่าด้วยการควบคุมผลิตภัณฑ์ยาสูบ (FCTC) อย่างไรก็ดี การจำกัดห้ามใช้เครื่องหมายการค้าย่อมส่งผลกระทบต่อผู้เป็นเจ้าของหลายประการ ดังนั้น บทวิเคราะห์นี้จึงเป็นการวิเคราะห์ความเป็นไปได้ในการใช้มาตรการซองเรียบในประเทศไทยกับประเด็นทางกฎหมายที่เกี่ยวข้องโดยเฉพาะผลกระทบต่อผู้เป็นเจ้าของเครื่องหมายการค้า และควรคำนึงถึงหลักกฎหมายอื่นๆ ด้วย เช่น การให้อำนาจในการออกกฎหมายลำดับรอง ทั้งนี้เพื่อเป็นประโยชน์ในการประกอบการพิจารณาปรับปรุงร่างพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบต่อไป
