The Justice and The Constitution for the Asean Community in 2015

Abstract

Now, every countries in the world are looking for the Asean Community in 2015 that consists of Indonesia, The Philippines, Singapore, Malaysia, Brunei Darussalam, Vietnam, Laos, Myanmar and Cambodia. Because of Thailand locates in the center among these countries, Thailand shall to prepare the host for the legal reform especially the justice of citizen under the Constitution. This justice at least consists of the equal before the law, due process of law and the rule of laws. As the result of the analysis of ten countries, Each country has different criteria in term of the justice of citizen. Therefore, each member shall to set up standard criteria in 2015 although the difference in politic, law system or court system.

For the unity of the Asean Community and the Justice of citizen among members, the Asean Community shall to set up the Asean Constitution that prescribes only the Basic Rights of citizen members and the Asean Constitutional Court that decides the provisions of the Constitution of each country are contrary to or inconsistent with the Asean Constitution. And also, the Asean Constitutional Court shall to locate in Thailand.
