บทคัดย่อ
ศาลเยาวชนและครอบครัว มิได้เป็นเพียงศาลยุติธรรม เท่านั้น แต่เป็นศาลที่ต้องช่วยแก้ปัญหาให้แก่คู่ความที่มาศาลด้วย ศาลเยาวชนและครอบครัวจึงจัดตั้งขึ้นเพื่อแก้ไขปัญหาสังคมและคุ้มครองสวัสดิภาพของประชาชน ในส่วนคดีคุ้มครองสวัสดิภาพนั้น ศาลเยาวชนและครอบครัวมีเขตอำนาจพิจารณาพิพากษาหรือมีคำสั่งทั้งในคดีอาญาและคดีแพ่ง ในส่วนคดีอาญา ศาลเยาวชนและครอบครัวมีอำนาจพิพากษาลงโทษผู้กระทำความผิดตามพระราชบัญญัติคุ้มครองผู้ถูกกระทาด้วยความรุนแรงในครอบครัว พ.ศ.2550 และพระราชบัญญัติ คุ้มครองเด็ก พ.ศ.2546 และในระหว่างการดำเนินคดีอาญาศาลที่พิจารณาคดีนั้นก็อาจมีคำสั่งระงับยับยั้งการกระทาความรุนแรงในครอบครัว หรือการปฏิบัติต่อเด็กโดยมิชอบด้วยกฎหมายได้ แต่ในส่วนคดีแพ่งศาลเยาวชนและครอบครัวมีอำนาจสั่งระงับยับยั้งการกระทำและการปฏิบัติดังกล่าวได้เมื่อมีการร้องขอต่อศาลเยาวชนและครอบครัวโดยไม่จำเป็นต้องมีการดำเนินคดีอาญา การคุ้มครองสวัสดิภาพในส่วนคดีแพ่งจึงมีความรวดเร็วและมีประสิทธิภาพในการระงับยับยั้งการกระทาความรุนแรงในครอบครัว หรือการปฏิบัติต่อเด็กโดยมิชอบด้วยกฎหมายมากกว่า ในส่วนคดีอาญา อย่างไรก็ดี การคุ้มครองสวัสดิภาพในส่วนคดีแพ่งมีปัญหาการที่ประชาชนยังขาดการตระหนักและรับรู้ถึงสิทธิหน้าตามกฎหมาย ในขณะที่ผู้พิพากษาศาลเยาวชนและครอบครัวก็ยังขาดความรู้ความเชี่ยวชาญที่เพียงพอต่อการบังคับการให้เป็นไปตามกฎหมายจึงเป็นผลให้การดำเนินคดีคุ้มครองสวัสดิภาพในส่วนคดีแพ่งยังไม่บรรลุผลตามเจตนารมณ์ของกฎหมายในการระงับยับยั้งกระทำความรุนแรงในครอบครัว หรือการปฏิบัติต่อเด็กโดยมิชอบด้วยกฎหมายอย่างรวดเร็วและมีประสิทธิภาพ แนวทางแก้ไขปัญหาดังกล่าว คือ การทำให้ประชนได้ตระหนักและรับรู้ถึงสิทธิหน้าที่ของตนเกี่ยวกับคดีคุ้มครองสวัสดิภาพในส่วนคดีแพ่งโดยศาลยุติธรรมควรทำการเผยแพร่ความรู้เกี่ยวกับการขอให้ศาลเยาวชนและครอบครัวคุ้มครองสวัสดิภาพในส่วนคดีแพ่งให้แก่ประชาชนโดยทั่วไปได้ทราบอย่างทั่วถึงและมากขึ้น รวมทั้งควรทำการอบรมผู้พิพากษาศาลเยาวชนและครอบครัวอย่างสม่ำเสมอและต่อเนื่องเพื่อเพิ่มพูนความรู้ ความเชี่ยวชาญที่เพียงพอต่อการบังคับการให้เป็นไปตามกฎหมายซึ่งจะเป็นประโยชน์อย่างยิ่งต่อการระงับยับยั้งกระทำความรุนแรงในครอบครัว หรือการปฏิบัติต่อเด็กโดยมิชอบด้วยกฎหมายได้อย่างมีประสิทธิภาพและรวดเร็วมากยิ่งขึ้นตามเจตนารมณ์ของกฎหมายอันจะก่อให้เกิดความสงบสุขในครอบครัวและสังคมโดยรวมต่อไป
