บทคัดย่อ
ประเทศไทยยอมรับการตายโดยสงบ แบบ passive euthanasia ในรูปแบบสิทธิของบุคคลในการแสดงเจตนาปฏิเสธการรับบริการสาธารณสุขที่เป็นไปเพียงเพื่อยืดการตายในวาระสุดท้ายของชีวิต หรือเพื่อยุติความทุกข์ทรมานจากการเจ็บป่วยได้ ในมาตรา 12 พระราชบัญญัติสุขภาพแห่งชาติ พ.ศ. 2550 มาตราดังกล่าวไม่ได้บัญญัติหลักเกณฑ์การแสดงเจตนาปฏิเสธการรักษาเมื่ออยู่ในวาระสุดท้ายของชีวิตของผู้ป่วยเด็กไว้ จึงมีการเสนอให้นำหลักเกณฑ์การแสดงเจตนาของเด็กในกฎหมายแพ่ง และหลักเกณฑ์การให้ความยินยอมในทางการแพทย์ของผู้ป่วยเด็กมาใช้เป็นหลักเกณฑ์การแสดงเจตนาปฏิเสธการรักษาเมื่ออยู่ในวาระสุดท้ายของชีวิต อย่างไรก็ตาม หลักเกณฑ์ดังกล่าวกำหนดเกณฑ์ความสามารถในการให้ความยินยอมของเด็ก และการมีส่วนร่วมในการให้ความยินยอมของบิดามารดาไว้แตกต่างกัน จึงทำให้เกิดปัญหาความไม่ชัดเจนของหลักเกณฑ์การแสดงเจตนาปฏิเสธการรักษาเมื่ออยู่ในวาระสุดท้ายของผู้ป่วยเด็ก
