ประวัติศาสตร์กฎหมายในทางทฤษฎีและการปฏิบัติ: ประสบการณ์ของไทยในมุมมองแองโกลแซกซอน

บทคัดย่อ
บทความนี้ มีจุดมุ่งหมายในการเปรียบเทียบการศึกษาประวัติศาสตร์กฎหมายไทยกับการศึกษาประวัติศาสตร์กฎหมายในโลกแองโกลแซกซอน โดยทั่วไปเป็นที่เข้าใจกันว่ามีประวัติศาสตร์กฎหมายเพียงชนิดเดียว แต่ตามความเป็นจริงมิใช่เช่นนั้น โดยเฉพาะเห็นได้จากการศึกษาประวัติศาสตร์กฎหมายในโลกแองโกลแซกซอนที่มีการพัฒนาการแตกกิ่งก้านสาขามากมาย การสำรวจโลกแองโกลแซกซอนได้ผลดีอย่างหนึ่ง คือ การแยกประเภทของการศึกษาประวัติศาสตร์กฎหมายตามแต่วัตถุประสงค์ของการศึกษา ในบทความนี้ ผู้เขียนมุ่งชี้ให้เห็นว่าวิชาประวัติศาสตร์กฎหมายในไทยนี้เป็นสิ่งที่เกิดขึ้นใหม่และยังกระจัดกระจายอยู่ในส่วนที่เป็นลัทธิหรือ ความคิดก็แยกไปสอนในวิชานิติปรัชญา ส่วนประวัติศาสตร์หลักกฎหมายมักจะเน้นการยืมหลักและกฎเกณฑ์จากกฎหมายต่างประเทศ ดังนั้น ผู้เขียนเสนอแนะว่าอนาคตของการศึกษาประวัติศาสตร์กฎหมายไทย น่าจะรวบรวมให้เป็นปึกแผ่นมากกว่าที่เป็นอยู่ในขณะนี้ เช่น ควรจะนำประวัติศาสตร์ความคิดมารวมไว้กับประวัติศาสตร์หลักเกณฑ์ และสถาบันด้วย ทั้งนี้ การศึกษาประวัติศาสตร์กฎหมายควรจะดำเนินการโดยทั้งนักประวัติศาสตร์และนักกฎหมายที่สนใจประวัติศาสตร์กฎหมาย บทความนี้จะนำเสนอรายละเอียดต่างๆ ตามลำดับดังนี้ (1) บทนำ (2) ประโยชน์ของการใช้วิธีประวัติศาสตร์ (3) ประเภทของการศึกษาประวัติศาสตร์กฎหมายแองโกลแซกซอน (4) การสอนและการวิจัยประวัติศาสตร์กฎหมายในประเทศไทย(5) บทสรุป
