การมีส่วนร่วมของชุมชนในการดูแลผู้กระทำความผิดที่เป็นเด็กและเยาวชน

บทคัดย่อ
พระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ. 2553 ได้กำหนดให้ชุมชนมีส่วนร่วมในขั้นตอนการประชุมเพื่อจัดทำแผนแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนทั้งในชั้นก่อนฟ้องคดีและหลังฟ้องคดี อย่างไรก็ตาม การมีส่วนร่วมของชุมชนตามพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ. 2553 ยังคงมีปัญหา 3 ประการ คือ (1) ปัญหาการให้ดุลยพินิจแก่ผู้อำนวยการสถานพินิจและคุ้มครองเด็กและเยาวชนในการเชิญผู้แทนชุมชนเข้ามามีส่วนร่วมในการกำ หนดแผนแก้ไขบำบัดฟื้นฟู (2) ปัญหารูปแบบการมีส่วนร่วมของชุมชนในการดูแลผู้กระทำความผิดที่เป็นเด็กและเยาวชน (3) ปัญหาระดับการมีส่วนร่วมของชุมชนในการดูแลผู้กระทำความผิดที่เป็นเด็กและเยาวชน ด้วยเหตุนี้จึงควรแก้ไขเพิ่มเติมพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ. 2553 โดยกำหนดให้ผู้อำนวยการสถานพินิจและคุ้มครองเด็กและเยาวชนไม่มีดุลยพินิจในการเชิญผู้แทนชุมชนเข้าร่วมในการประชุมเพื่อจัดทำแผนแก้ไขบำบัดฟื้นฟู แต่ควรกำหนดให้ผู้แทนชุมชนเป็นกรรมการและเข้าร่วมในการประชุมเพื่อจัดทำแผนแก้ไขบำบัดฟื้นฟูได้โดยตรง และไม่จำกัดรูปแบบของการมีส่วนร่วมไว้ในขั้นตอนของการวางแผนและการปฏิบัติเท่านั้น แต่ควรให้ชุมชนสามารถมีส่วนร่วมในขั้นตอนของการติดตามและประเมินผลด้วย รวมทั้ง ควรปรับปรุงหรือพัฒนากฎหมายเพื่อให้ชุมชนมีส่วนร่วมในการดูแลผู้กระทำความผิดที่เป็นเด็กและเยาวชนดังเช่นที่ชุมชนมีความคาดหวังและมีความพร้อม
