บทคัดย่อ
การแพร่ระบาดของไวรัส Covid-19 นับเป็นปรากฎการณ์ทางธรรมชาติที่เกิดขึ้นที่มนุษย์ไม่ได้คาดคิดและส่งผลกระทบอย่างหนักทั้งทางด้านเศรษฐกิจ สังคม การใช้ชีวิตประจำวัน และแม้กระทั้งกระบวนการยุติธรรมทางกฎหมายเองก็ตาม ในสหรัฐอเมริกาที่มีผู้ติดเชื้อมากที่สุดในโลกได้ปรับเปลี่ยนกระบวนการยุติธรรมทางอาญาในหลายขั้นตอนด้วยกัน ทั้งกระบวนการก่อนการพิจารณา ระหว่างการพิจารณาคดีของศาล และในชั้นบังคับโทษ บทเรียนจากสหรัฐอเมริกาสามารถนำมาปรับใช้กับประเทศไทยได้ในหลายขั้นตอนด้วยกัน แต่หากจะนำมาปรับใช้จำเป็นจะต้องมีการทบทวนไตร่ตรองจากทุกหน่วยงานที่เกี่ยวข้องในกระบวนการยุติธรรมทางอาญาด้วยเสียก่อนเพื่อก่อให้เกิดการปรับตัวที่เหมาะสมกับสถานการณ์และยังดำรงไว้ซึ่งความเป็นธรรมในกระบวนการยุติธรรมทางอาญาไทยด้วย
