บทคัดย่อ
งานศึกษาชิ้นนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาของกลไกทางกฎหมายในการคุ้มครองสิทธิแรงงาน การจัดหางานและการจ้างงานที่เป็นธรรมภายใต้ข้อตกลงระหว่างประเทศไทยและประเทศเมียนมาและเสนอแนวทางในการแก้ไขปัญหาที่เกิดจากกลไกดังกล่าว โดยใช้การทบทวนเอกสารและการสัมภาษณ์เชิงลึกผู้ที่เกี่ยวข้อง จากการศึกษาวิจัย พบว่า นโยบายและกฎหมายไทยส่วนใหญ่สอดคล้องกับมาตรฐานระหว่างประเทศ ปัญหาอยู่ที่การบังคับใช้กฎหมายในบางเรื่อง ได้แก่ ค่าธรรมเนียมและค่าใช้จ่ายในการจัดหางานและจ้างงานที่ยังคงสูงอยู่ การเก็บเอกสารหรือรับฝากเอกสารของลูกจ้างโดยนายจ้าง เงื่อนไขที่จำกัดของการเปลี่ยนนายจ้าง และการเลิกสัญญา การเข้าถึงกลไกการร้องทุกข์กรณีการจัดหางาน และการเข้าถึงสิทธิประโยชน์ในกองทุนประกันสังคมและกองทุนเงินทดแทน ผลการวิจัยนำไปสู่ข้อเสนอให้รัฐดำเนินการดังนี้ หนึ่ง ควรมีการเจรจาเพิ่มเนื้อหาเรื่องค่าธรรมเนียมและค่าใช้จ่ายในการจัดหางานและเรื่องการเปลี่ยนแปลงนายจ้างให้อยู่ในข้อตกลงระหว่างรัฐ สอง ควรจัดทำแนวปฏิบัติให้มีความชัดเจนในการเรื่องหลักเกณฑ์ในการหักค่าจ้างและการหักหนี้ที่เกิดขึ้นระหว่างนายจ้างและลูกจ้างและทบทวนแนวทางในการรับฝากเอกสารส่วนตัวและสัญญาจ้าง สาม ควรพิจารณาปรับแก้ไขกฎหมายส่วนของเงื่อนไขการเปลี่ยนนายจ้าง โดยไม่ขึ้นอยู่กับความผิดของลูกจ้างหรือนายจ้าง สี่ ควรปรับปรุงขั้นตอนการรับเรื่องร้องทุกข์และสร้างระบบส่งต่อคดีเพื่อลดภาระของนายจ้างและลูกจ้าง และ ห้า ควรปรับปรุงการเข้าถึงสิทธิประโยชน์ในกองทุนประกันสังคมและกองทุนเงินทดแทนของแรงงานข้ามชาติเพื่อให้แรงงานข้ามชาติสามารถเข้าถึงกองทุนได้เท่าเทียมกับแรงงานไทย
