บทคัดย่อ
บทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นไปได้ในการพัฒนากฎหมายว่าด้วยอุทยานแห่งชาติของประเทศไทย โดยผู้เขียนเห็นว่า การที่จะพัฒนากฎหมายดังกล่าวเป็นกฎหมายที่ทันสมัย ทัดเทียมกับอารยประเทศนั้น จะต้องมีการปรับเปลี่ยนแนวคิด
ใน พระราชบัญญัติอุทยานแห่งชาติ พ.ศ. 2504 ให้มีความสอดคล้องกับหลักการที่เรียกว่าหลักการพัฒนาอย่างยั่งยืน ในบริบทของกฎหมายสิ่งแวดล้อมภายในเอง หลักการนี้เป็นหลักการที่สําาคัญมากที่จะทําาให้ คุณค่าที่สําาคัญตามหลักการดังกล่าวได้รับการประสานร่วมกัน นั่นคือคุณค่าทางด้านการพัฒนาและคุณค่าทางด้านสิ่งแวดล้อม ประเทศที่พัฒนาแล้วในหลายประเทศได้นําาหลักการนี้ไปบัญญัติไว้ในระบบของกฎหมายสิ่งแวดล้อมและอนุรักษ์ทรัพยากรธรรมชาติของประเทศนั้นๆ อาทิเช่น ประเทศแคนาดา เมื่อได้ศึกษาบทเรียนจากประเทศแคนาดาแล้วเห็นว่า ส่วนที่เกี่ยวข้องกับกฎหมายว่าด้วยอุทยานแห่งชาติของแคนาดาสอดคล้องกับหลักการพัฒนาอย่างยั่งยืน ซึ่งน่าจะนําามาเป็นแนวทางในการแก้ไขกฎหมายว่าด้วยอุทยานแห่งชาติของประเทศไทยต่อไปได้
ใน พระราชบัญญัติอุทยานแห่งชาติ พ.ศ. 2504 ให้มีความสอดคล้องกับหลักการที่เรียกว่าหลักการพัฒนาอย่างยั่งยืน ในบริบทของกฎหมายสิ่งแวดล้อมภายในเอง หลักการนี้เป็นหลักการที่สําาคัญมากที่จะทําาให้ คุณค่าที่สําาคัญตามหลักการดังกล่าวได้รับการประสานร่วมกัน นั่นคือคุณค่าทางด้านการพัฒนาและคุณค่าทางด้านสิ่งแวดล้อม ประเทศที่พัฒนาแล้วในหลายประเทศได้นําาหลักการนี้ไปบัญญัติไว้ในระบบของกฎหมายสิ่งแวดล้อมและอนุรักษ์ทรัพยากรธรรมชาติของประเทศนั้นๆ อาทิเช่น ประเทศแคนาดา เมื่อได้ศึกษาบทเรียนจากประเทศแคนาดาแล้วเห็นว่า ส่วนที่เกี่ยวข้องกับกฎหมายว่าด้วยอุทยานแห่งชาติของแคนาดาสอดคล้องกับหลักการพัฒนาอย่างยั่งยืน ซึ่งน่าจะนําามาเป็นแนวทางในการแก้ไขกฎหมายว่าด้วยอุทยานแห่งชาติของประเทศไทยต่อไปได้
