สิทธิในสิ่งแวดล้อมในรัฐธรรมนูญของประเทศไทยศึกษาเปรียบเทียบกับกฎหมายต่างประเทศ

บทคัดย่อ
สิทธิในสิ่งแวดล้อม มีความหมายอย่างไร มีสาระสำคัญอย่างไร บทความฉบับนี้ แสดงให้เห็นว่าสิทธิในสิ่งแวดล้อมเป็นสิทธิที่เกี่ยวข้องกับทรัพยากรธรรมชาติและสิ่งแวดล้อมที่บุคคลทุกคนพึงมีและได้รับ โดยสิทธินี้แบ่งแยกไม่ได้และติดตัวทุกคนมากตั้งแต่เกิด ทั้งนี้สิทธินี้แบ่งเป็นสิทธิเชิงเนื้อหา (Substantive Rights)และสิทธิเชิงกระบวนการ (Procedural Rights) นี้ควรบรรจุไว้ในรัฐธรรมนูญฯของไทยที่ผ่านมาตั้งแต่อดีตจนถึงปัจจุบัน จากการศึกษาพบว่า สิทธิในสิ่งแวดล้อมนั้นประเทศไทยมีการบัญญัติไว้เฉพาะสิทธิเชิงกระบวนการ (Procedural Rights) ไว้ในรัฐธรรมนูญฯที่ผ่านมาในหลายๆ ฉบับยกเว้นรัฐธรรมนูญฯ ปัจจุบันปี พ.ศ. 2560 ที่จะต้องออกเป็นกฎหมายลูกหรือพระราชบัญญัติอีกครั้ง ส่วนในต่างประเทศพบว่าในปี พ.ศ. 2552 มีการบัญญัติสิทธินี้ไว้ทั้งสิทธิเชิงเนื้อหา (Substantive Rights) และสิทธิเชิงกระบวนการ (Procedural Rights) ในรัฐธรรมนูญแล้วมากกว่า177 ใน 193 ประเทศของสมาชิกสหประชาชาติทั้งหมดทั่วโลก
