เหตุลดโทษในคดีอาญากรณีผู้หญิงถูกกระทำความรุนแรงในครอบครัวกระทำความผิด: การศึกษาเปรียบเทียบกฎหมายไทยและอังกฤษ

บทคัดย่อ
ประเทศไทยพบคดีหญิงฆ่าสามีอันเนื่องมาจากการกระทำความรุนแรงในครอบครัวอยู่บ่อยครั้ง โดยแต่ละคดีภรรยามักอ้างถึงความเครียดที่ถูกสามีทำร้ายเป็นระยะเวลานานจึงตอบโต้ด้วยความรุนแรงดังกล่าว เมื่อถึงชั้นพิจารณาคดี บางคดีต่อสู้ด้วยเหตุป้องกันตัวหรือบันดาลโทสะตามประมวลกฎหมายอาญามาตรา 68 และ 72 ตามลำดับ ซึ่งการพิเคราะห์นั้นเป็นการตีความตามหลักกฎหมายว่าด้วยการป้องกันตัวหรือบันดาลโทสะโดยมิได้ยกความเครียดสะสมของผู้หญิงเป็นประเด็นประกอบ ในต่างประเทศ เช่น สหรัฐอเมริกา ออสเตรเลีย แคนาดา อังกฤษ เรียกลักษณะอาการดังกล่าวของผู้หญิงที่ถูกทำร้ายโดยสามีจนเกิดความบกพร่องทางจิตใจว่า Battered Woman Syndrome (BWS) บางคดีในต่างประเทศภรรยาฆ่าสามีอาจยกอาการ BWS ต่อสู้เพื่อเป็นเหตุลดโทษได้ โดยประเทศอังกฤษมีหลายคดีที่ยอมรับอาการ BWS เป็นข้อต่อสู้ในคดีลักษณะดังกล่าวเพื่อลดโทษโดยอาจเป็น การป้องกันตัว หรือไม่สามารถควบคุมตนเองได้ (บันดาลโทสะ) หรือ ขอลดหย่อนความรับผิด เมื่อเปรียบเทียบระหว่างประเทศไทยกับประเทศอังกฤษแล้วพบว่ามีความแตกต่างกันในหลายส่วนทั้งนิติวิธี โครงสร้างความรับผิดอาญา การต่อสู้เพื่อขอลดโทษทั้งหลักการป้องกันตัวหรือบันดาลโทสะ แต่เมื่อวิเคราะห์แล้วหากประเทศไทยจะปรับปรุงกฎหมายในเรื่องนี้อาจเป็นการตีความขยายการบันดาลโทสะ ตามมาตรา 72 ให้ครอบคลุมอาการผู้หญิงถูกทำร้ายจากสามีเป็นระยะเวลานานสะสม ที่ประเทศอังกฤษเรียกว่า cumulative provocation เพื่ออำนวยความยุติธรรมกับคดีและพัฒนากฎหมายให้ทัดเทียมอารยะประเทศ
