บทคัดย่อ
เนื่องจากสังคมมีความเจริญก้าวหน้าทางเศรษฐกิจและเทคโนโลยีจึงทำให้การพัฒนาโรงงานอุตสาหกรรมเกิดขึ้นอย่างรวดเร็ว มีการผลิตทางอุตสาหกรรมเพิ่มมากขึ้น และสิ่งที่ตามมาจากโรงงานอุตสาหกรรม คือ “มลพิษ” โรงงานอุตสาหกรรมจึงเป็นแหล่งกำเนิดมลพิษที่สำคัญและส่งผลกระทบต่อสิ่งแวดล้อม การตรวจสอบแหล่งกำเนิดมลพิษเป็นกลไกหนึ่งในการป้องกันและแก้ไขปัญหามลพิษ ซึ่งพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 บัญญัติให้เจ้าพนักงานควบคุมมลพิษทำหน้าที่ในการตรวจสอบแหล่งกำเนิดมลพิษ แต่พบว่าการตรวจสอบแหล่งกำเนิดมลพิษยังไม่มีประสิทธิภาพ บทความนี้จึงจะพิจารณาอำนาจของเจ้าพนักงานควบคุมมลพิษตามพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ในการตรวจสอบแหล่งกำเนิดมลพิษ ประเภทโรงงานอุตสาหกรรมและเสนอแนวทางในการแก้ไขปัญหาดังกล่าวต่อไป
