มาตรการทางกฎหมายเพื่อส่งเสริมการอนุรักษ์และการใช้ทรัพยากรพันธุกรรมพืชอย่างยั่งยืน

บทคัดย่อ
มาตรการทางกฎหมาย การบริหารจัดการและนโยบายที่เกี่ยวกับความหลากหลายทางชีวภาพที่สอดคล้องกับหลักการตามอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพอย่างเหมาะสมและมากที่สุดเท่าที่จะเป็นไปได้นั้น ย่อมส่งผลให้เกิดการส่งเสริมการอนุรักษ์และการใช้ทรัพยากรพันธุกรรมพืชอย่างยั่งยืนรวมทั้งส่งเสริมให้เกิดการเข้าถึงและการแบ่งปันผลประโยชน์อันเกิดจากการใช้ทรัพยากรพันธุกรรมอย่างเป็นธรรมและเท่าเทียมกันได้ จากการศึกษาวิจัยพบว่ากฎหมายว่าด้วยการอนุรักษ์และการใช้ทรัพยากรพันธุกรรมพืชของประเทศไทยไม่สอดคล้องกับวัตถุประสงค์และหลักการตามอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพดังนั้น เพื่อให้สอดคล้องกับหลักการดังกล่าว ประเทศไทยควรดำเนินการดังต่อไปนี้
1) บัญญัติกฎหมายว่าด้วยความหลากหลายทางชีวภาพขึ้นมาเป็นกฎหมายใหม่ที่มีหลักการ แนวทางสอดคล้องกับอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพอย่างเหมาะสมและมากที่สุดเท่าที่จะเป็นไปได้
2) จัดตั้งองค์กรขึ้นมาใหม่เพื่อบริหารจัดการด้านความหลากหลายทางชีวภาพรวมถึงทรัพยากรพันธุกรรมพืชโดยให้อยู่ภายใต้กฎหมายฉบับนี้
