ปัญหาทางกฎหมายเกี่ยวกับการจัดการทรัพยากรประมง

บทคัดย่อ
จากการที่รัฐธรรมนูญมีหลักการที่รับรองให้ชุมชนและประชาชนมีสิทธิในการมีส่วนร่วมอนุรักษ์และใช้ประโยชน์จากทรัพยากรธรรมชาตริ วมถงึ ทรพั ยากรประมง แตใ่ นการดำเนินมาตรการดังกล่าว พบว่ายังมีข้อจำกัดทางกฎหมายหลายประการ อาทิ การกระจายอำนาจสู่ท้องถิ่นยังไม่สมบูรณ์ เกิดช่องว่างของการใช้อำนาจในระหว่างองค์กรผู้ใช้อำนาจเดิมกับองค์กรท้องถิ่นผู้รับโอนอำนาจ การใช้สิทธิมีส่วนร่วมของชุมชนและประชาชน ยังไม่มี กฎหมายที่กำหนดรายละเอียด และ/หรือวิธีการใช้สิทธิในการมีส่วนร่วมดังกล่าว ประกอบกับการทำประมงที่เกินขนาด และการแย่งชิงทรัพยากรประมงระหว่างประมงชายฝั่งกับประมงพาณิชย์จึงควรบัญญัติกฎหมายรองรับการมีส่วนร่วมของชุมชนและประชาชนในการจัดการทรัพยากรประมงในท้องถิ่น รวมทั้งมาตรการจัดการทรัพยากรประมงให้คงไว้สำหรับการใช้ประโยชน์ได้อย่างยั่งยืน
