บทคัดย่อ
นับแต่อดีต แหล่งรายได้นำเข้าที่สำคัญของประเทศไทยมาจากการค้าการส่งออกสินค้า ในด้านวิธีการขนส่งสินค้าของประเทศไทยปรากฏว่า สินค้ากว่าร้อยละ 90 ของปริมาณสินค้าส่งออกทั้งหมดอาศัยการขนส่งทางทะเลเป็นสำคัญและมีแนวโน้มที่จะขยายตัวอย่างต่อเนื่อง กิจการท่าเรือเดินทะเลนับเป็นกิจการที่สำคัญอย่างยิ่งต่อการสนับสนุนการขนส่งทางทะเลระหว่างประเทศและถือว่าเป็นกิจการสาธารณูปโภคที่สำคัญต่อการพัฒนาเศรษฐกิจ การประกอบกิจการท่าเรือของไทยมีทั้งหน่วยงานของรัฐเป็นเจ้าของและดำเนินการ รวมทั้งภาคเอกชนได้เข้ามาเป็นผู้ประกอบการด้วยตนเองเพื่อตอบสนองต่อความต้องการของตลาดการค้าการขนส่งทางทะเล ด้วยความสำคัญของกิจการท่าเรือดังกล่าว รัฐจึงเข้ามาแทรกแซงการประกอบกิจการท่าเรือของเอกชน เนื่องจากเป็นกิจการสาธารณูปโภคที่มีผลต่อความปลอดภัยและความผาสุกของสาธารณชน ในกรณีที่เป็นท่าเรือของรัฐที่มีกฎหมายให้อำนาจเป็นการเฉพาะแล้วย่อมมีสิทธิประกอบการได้ภายใต้กฎหมายดังกล่าว เช่น ท่าเรือที่เป็นของการท่าเรือแห่งประเทศไทย แต่ในกรณีของท่าเรือของเอกชนและท่าเรือของหน่วยงานของรัฐที่ยังไม่มีกฎหมายให้สิทธิในการประกอบการไว้ ผู้ที่จะประกอบกิจการท่าเรือ จะต้องดำเนินการเพื่อให้ได้รับอนุญาตก่อนตามประกาศของคณะปฏิวัติฉบับที่ 58 พ.ศ. 2515 และพระราชกฤษฎีกากำหนดให้กิจการท่าเรือเดินทะเลเป็นกิจการค้าขายอันเป็นสาธารณูปโภคอันกระทบกระเทือนถึงความปลอดภัยและความผาสุกของประชาชน พ.ศ. 2522 บทความเรื่องนี้เป็นการนำเสนอถึงความสำคัญ บทบาทหน้าที่ของกิจการท่าเรือ ความเป็นมาและสาระสำคัญของกฎหมายดังกล่าว รวมทั้งวิเคราะห์หลักเกณฑ์ เนื้อหาสาระที่ใช้ในการกำกับดูแลกิจการท่าเรือที่ต้องขออนุญาตภายใต้ประกาศของคณะปฏิวัติฉบับที่ 58 พ.ศ. 2515
