การบังคับใช้กฎหมายเพื่อการคุ้มครองสิทธิของลูกจ้าง ภาคประมงทะเลในจังหวัดสงขลา

บทคัดย่อ
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาสภาพการใช้แรงงานภาคประมงทะเล ปัญหาและอุปสรรคของการบังคับใช้กฎหมายเพื่อการคุ้มครองสิทธิของลูกจ้างแรงงานภาคประมงทะเลในจังหวัดสงขลา ผลการศึกษาพบว่า อาชีพประมงต้องทำงานหนัก (Difficult) มีความเสี่ยงภัยหลายประเภท (Dangerous) และสภาพงานสกปรกอยู่ตลอดเวลา (Dirty) หรือลักษณะงาน 3Ds ตลอดจนไม่สามารถกำหนดเวลาการทำงานได้แน่นอนดังเช่นงานทั่วไป ด้านการคุ้มครองสิทธิของลูกจ้างภาคประมงทะเล มีกฎกระทรวงคุ้มครองแรงงานในงานประมงทะเล พ.ศ. 2557 เพียงฉบับเดียวที่ให้ความคุ้มครองลูกจ้างภาคประมงทะเล แต่ก็ไม่ได้กล่าวถึงเงินทดแทนกรณีลูกจ้างประสบอันตรายอันเนื่องมาจากการทำงานแต่อย่างใด ซึ่งทำให้ลูกจ้างยังขาดมาตรการ กลไกภาครัฐในการให้ความคุ้มครองสิทธิประโยชน์และสวัสดิการต่างๆ ส่งผลให้ไม่มีความมั่นคงและขาดหลักประกันในชีวิตดังเช่นลูกจ้างทั่วไป ดังนั้น จึงเสนอแนะให้มีการออกกฎหมายเป็นการเฉพาะ เพื่อสร้างกลไกและมาตรการคุ้มครองสิทธิประโยชน์และสวัสดิการของลูกจ้างที่เหมาะสมกับสภาพการณ์ที่เปลี่ยนแปลงไปและเทียบเคียงกับแรงงานในกิจการประเภทอื่น อันจะส่งผลให้เป็นแรงจูงใจให้คนมารับจ้างเป็นแรงงานในกิจการประมงทะเลมากขึ้นอย่างยั่งยืนสืบไป
