ปัญหาทางกฎหมายลิขสิทธิ์ที่เกี่ยวข้องกับ การจำหน่ายจ่ายโอนต่อสินค้าที่อยู่ในรูปแบบดิจิทัล

บทคัดย่อ
การจำหน่ายจ่ายโอนต่อสินค้าอันมีลิขสิทธิ์ที่อยู่ในรูปแบบดิจิทัล โดยธรรมชาติมีความแตกต่างจากสินค้าที่อยู่ในรูปแบบจับต้องได้ จึงก่อให้เกิดประเด็นปัญหาถกเถียงด้วยกัน 3 ประเด็น คือ 1) สิทธิความเป็นเจ้าของ กรณีซื้อขายนั้นเป็นสัญญาซื้อขาย หรือเป็นเพียงสัญญาอนุญาตให้ใช้สิทธิ 2) วิธีการจำหน่ายจ่ายโอนที่หลีกเลี่ยงการทำซ้ำได้ยาก 3) หลักการสิ้นสิทธิสามารถนำมาปรับใช้กับสินค้าอันมีลิขสิทธิ์ที่อยู่ในรูปแบบดิจิทัลได้ ซึ่งไม่ว่าจะตีความไปในทิศทางใดย่อมส่งผลกระทบต่อเจ้าของลิขสิทธิ์และผู้บริโภคโดยตรง จากการวิจัยพบว่าการเแก้ไขปัญหาดังกล่าว ควรตีความให้สินค้าอันมีลิขสิทธิ์ที่อยู่ในรูปแบบดิจิทัลสามารถจำหน่ายจ่ายโอนต่อได้โดยชอบด้วยกฎหมาย ควบคู่กับการนำเทคโนโลยีที่เกี่ยวข้องโดยเฉพาะเข้ามาปรับใช้ เพื่อแก้ไขผลกระทบที่เกิดแก่เจ้าของลิขสิทธิ์และคุ้มครองผู้บริโภคที่ซื้อสินค้ามาโดยชอบด้วยกฎหมายให้มีสิทธิเท่าเทียมผู้บริโภคที่ซื้อสินค้าที่อยู่ในรูปแบบจับต้องได้
