ข้อยกเว้นของการเปิดเผยข้อมูลตามพระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ. 2540 : ศึกษากรณีข้อมูลส่วนบุคคล

บทคัดย่อ
แม้ว่าพระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ. 2540 กำหนดให้การเข้าถึงข้อมูลและการเปิดเผยข้อมูลเป็นหลักสำคัญ แต่ก็ได้กำหนดข้อยกเว้นในการเปิดเผยข้อมูลไว้หลายประการ โดยในบทความนี้จะมุ่งศึกษาข้อยกเว้นเพื่อการคุ้มครองข้อมูลส่วนบุคคล อันปรากฎอยู่ใน มาตรา 15 ของพระราชบัญญัติดังกล่าว การกำหนดข้อยกเว้นนี้มีลักษณะคล้ายคลึงกับกฎหมายสหรัฐอเมริกา โดยในปัจจุบันทั้งไทยและสหรัฐอเมริกาต่างก็ไม่มีกฎหมายกลางที่มีผลเป็นการคุ้มครองข้อมูลส่วนบุคคลเป็นการทั่วไป อย่างไรก็ตามประเด็นปัญหาที่สำคัญก็คือ เมื่อร่างพระราชบัญญัติข้อมูลส่วนบุคคลมีผลใช้บังคับแล้ว กฎหมายไทยจะแตกต่างกับกฎหมายสหรัฐอเมริกา แต่จะไปมีลักษณะคล้ายคลึงกับกฎหมายสหราชอาณาจักรซึ่งมีพระราชบัญญัติข้อมูลส่วนบุคคลเป็นการเฉพาะ บทความนี้จึงทำการศึกษาข้อยกเว้นมาตรา 15 ของไทย เฉพาะในส่วนมาตรา 15 (5) และ 15 (6) ในส่วนที่เกี่ยวข้องกับข้อมูลส่วนบุคคล โดยวิเคราะห์เปรียบเทียบกับกฎหมายของสหรัฐอเมริกาและสหราชอาณาจักร ผลการวิเคราะห์นำไปสู่ข้อเสนอแนะในการปรับปรุงพระราชบัญญัติข้อมูลข่าวสารของราชการให้สอดคล้องกับการคุ้มครองข้อมูลส่วนบุคคลตามกฎหมายเฉพาะต่อไป
