The exemption to the information disclosure principle of The Official Information Act B.E. 2540 : A Study of Personal Information

Abstract

Although the Official Information Act B.E. 2540 affirms the right  to access official information as its main principle, this Act stipulates several exception including the protection of personal data in Section 15.  Comparing to the US’s law, both Thai and U.S. have no specific laws for protecting personal data in a general level. In addition, the exception in Section 15 is similar to the exception in the U.S. Freedom of Information Act.  However, the personal data protection draft bill which has been approved and proposed by the cabinet in January 2015 is currently being considered. After this law comes into force, Thai law relating to personal data would be similar to the UK which has data protection Act as specific law for protecting personal data.  This article aims at studying exceptions in Section 15 of the Official Information Act especially Section 15 (5) and 15 (6) with regards to the protection of personal data by comparing such sections to the U.S. and U.K. related laws. The results of analysis leads to the proposal to amend the Official Information Act B.E. 2540  to harmonize with the data protection Act.
