ปัญหาทางกฎหมายเกี่ยวกับส่วนประกอบของร่างกายมนุษย์

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์ (1) เพื่อศึกษาแนวทางแก้ไขปัญหาและข้อเสนอแนะในการบริจาคอวัยวะโดยผู้เกี่ยวข้องในร่างกายของผู้ตาย (2) เพื่อศึกษาแนวทางแก้ไขปัญหาที่เกี่ยวข้องในการมีข้อกำหนดการเผื่อตาย โดยศึกษากฎหมายไทยและกฎหมายต่างประเทศ ด้วยการวิจัยเชิงคุณภาพ (Qualitative research) โดยการวิจัยเอกสาร ( Documentary research)
ผลการวิจัยพบว่า ประเทศไทยกำหนดให้มีการบริจาคอวัยวะแบบสมัครใจแต่ประสบปัญหาขาดแคลนอวัยวะ ศพนิรนามหากอยู่ในภาวะสมองตายไม่เคยสมัครใจบริจาคอวัยวะไม่มีญาติให้ความยินยอม ย่อมทำให้ไม่สามารถนำอวัยวะมาใช้ปลูกถ่ายได้ การบริจาคอวัยวะโดยพินัยกรรมกฎหมายประเทศไทยไม่ได้กำหนดให้บริจาคโดยพินัยกรรมไว้ สำหรับประเทศสิงคโปร์ใช้การบริจาคอวัยวะระบบผสมด้วยการบริจาคแบบสมัครใจและการบริจาคภาคบังคับตามกฎหมาย (HOTA) หากไม่ประสงค์บริจาคสามารถถอนตัวได้ และพบว่าไม่มีการกำหนดให้ทำพินัยกรรมบริจาคอวัยวะ ส่วนประเทศสหรัฐอเมริกาพบว่า ใช้การบริจาคอวัยวะแบบสมัครใจและมีกฎหมายกำหนดการบริจาคอวัยวะโดยพินัยกรรม
ข้อเสนอแนะการวิจัย คือ ประเทศไทยควรออกกฎหมายการบริจาคอวัยวะภาคบังคับแบบประเทศสิงคโปร์ตามกฎหมาย (HOTA) เพื่อแก้ไขปัญหาการขาดแคลนอวัยวะโดยกฎหมายดังกล่าวไม่ได้บังคับจนไม่สามารถถอนตัวออกจากการบริจาคได้และกำหนดให้หน่วยงานสำนักงานตำรวจแห่งชาติ แพทยสภา สภากาชาดไทย สถาบันนิติวิทยาศาสตร์ เข้ามาจัดทำความร่วมมือพิจารณาอวัยวะศพนิรนามเพื่อนำมาปลูกถ่าย และควรกำหนดการทำพินัยกรรมบริจาคอวัยวะเพิ่มเติมไว้ในประกาศศูนย์รับบริจาคอวัยวะสภากาชาดไทยภายใต้ระเบียบสภากาชาดไทยว่าด้วยศูนย์รับบริจาคอวัยวะสภากาชาดไทย พ.ศ.2545 เรื่องการทำพินัยกรรมบริจาคอวัยวะ
