Uncertainty in the Exercise of Duties: A Legal Analysis of University Council Membership by Alumni Association Presidents under the Burapha University Act B.E. 2550

Abstract

This academic article aims to examine the problems surrounding the position of the President of the Alumni Association as an ex officio member of the University Council, as prescribed by several statutes establishing autonomous universities in Thailand. These statutes commonly designate the President of the Alumni Association as an ex officio University Council member. However, unlike other types of University Council members, there are no clear legal provisions specifying the qualifications or appointment procedures for this position. This gap has led to practical issues, such as the inability of an elected President of the Alumni Association to assume council duties while pending legal registration, and interpretive challenges regarding the legal status of the position.

This article focuses specifically on the case study of the Burapha University Act, B.E. 2550 (2007). The study found that the Act does not clearly define the criteria or process for appointing the President of the Alumni Association as a University Council member, resulting in legal ambiguity and procedural uncertainties. These issues affect the formality and legality of council operations.

The author recommends that the Burapha University Act, B.E. 2550 (2007), be amended to specify the source of authority and criteria for the President of the Alumni Association in their role as an ex officio University Council member. These criteria should be aligned with the Alumni Association’s regulations to clarify the legal status and improve the overall effectiveness of University Council functions.
