Technique for Writing Answer to Legal Exam “How to answer and achieve score”

Abstract

The legal exam of bachelor’s degree, master's degree and bar association as well as the entrance exam for Assistant Public Prosecutor or Assistant Judge, the legal examination questions get progressively more difficult.

The legal examinees’ serious problem in writing answers for legal exam is “giving a straight answer” but failing to achieve score. As the examination questions construct a complicated plot with a variety of issues, they limit time for consideration and writing each answer resulting in many problems. For example, the examinees read a question but fail to get the point, give an irrelevant answer causing time and thought consuming, hesitate about answer, write hurriedly and excitedly causing a lack of system thinking and planning resulting in confused answer, cannot find the starting point, compose a principle by self, adapt a principle by copying a question, write answer with irrelevant fact and write answer without the principles of law and legal reason.   

According to the study, it found that writing an answer for legal exam presented discussion and reason on the basis of law evidently. The examinees should find their defect and apply the “mixed method” of writing between writing step-by-step answer and absolute answer. The step-by-step answer presents the main issue and sub-issue. They are the main problem and provide score more than other issue. For the trivial issues, the absolute answer should be applied by considering and putting the text in the main issue’s answer and writing all issues in the answer reasonably and relevantly.
