Some Observations on the Prohibited Characteristics of Election Candidates in the case of Politicians’ Media Sharing

Abstract

This article seeks to study the issue of laws on election candidates’ prohibited characteristic in the context of politicians’ media shareholding under the Constitution of the Kingdom of Thailand, B.E. 2560 (2017) through a comparative analysis of the media shareholding laws of politicians in western democratic countries.

According to the study, it was found that the legislation pertaining to prohibited characteristic of election candidates in the context of media shareholding did not align with the spirit of the constitution. It was inherent in hyper-legalism and always employed as a tool for intimidation and political gain which adhered more to formal form than content.

The author offers legislative recommendations that Turkey, Brazil, Italy, Germany, Sweden, Australia, and other Western democracies do not forbid politicians from owning media outlets in order to uphold the values of diversity and pluralism in their communities and freedom of speech. To protect the values of freedom of speech and diversity or pluralism in society, their politicians are not forbidden from owning media.
