Legal Issues Regarding Recruitment Qualifications and Efficiency of Officers of the Department of Special Investigation

This research article aims to examine legal issues concerning the recruitment qualifications and operational effectiveness of officers of the Department of Special Investigation (DSI). Employing a qualitative research methodology, the study analyzes relevant laws and regulations, particularly the Special Case Investigation Act B.E. 2547 (2004), which still contains certain limitations resulting in insufficiently clear criteria governing the qualifications and recruitment of DSI officers. The study also reviews related theoretical concepts and compares Thai legislation with foreign legal frameworks in order to analyze existing problems and propose appropriate legal reforms.
The findings reveal that the laws and regulations governing the recruitment and professional development of DSI officers contain several shortcomings. Recruitment criteria for both direct entry applicants and transferred civil servants from other government agencies lack clarity and consistency, resulting in the absence of a uniform standard. Furthermore, training and capacity-building systems for officers following recruitment remain insufficiently structured and lack continuity. In addition, there are no regular competency assessment mechanisms to evaluate officers’ performance and professional capabilities. These deficiencies may adversely affect the effectiveness of DSI officers in carrying out their duties and responsibilities.
The study recommends that priority be given to competency development as the primary approach to enhancing personnel performance. Specifically, training programs and reassessment measures should be implemented as alternatives to punitive actions for officers who fail competency evaluations. Such measures would help address performance deficiencies, improve professional capabilities in accordance with established standards, enhance the effectiveness of DSI officers in performing their duties, and strengthen public confidence in the justice system as a whole.
