RECOMMENDATION FOR DEVELOPMENT OF THAI LAW BE IN LINE WITH THE CONVENTION ON WETLANDS

Abstract

The objectives of this research were to study about Wetland Convention, Thailand and aboard’s policies and measures regard on wetland conservation including analysis of legal problems, obstacles, and limitation on wetland conservation of Thailand. This research applied documentary research method.

The Wetlands Convention has the Wise Use concept as a key concept in wetland conservation including management and action planning for wetlands. Thailand, as a member of the convention, has established policies and measures on wetland conservation. But They are not yet effective enough to conserve wetlands. They also look inconsistent with the Wise Use concept. However, Thailand’s legal problems and obstacles concerning about the implementation of the laws, which including lack of provisions (which should be more comprehensive enough) to conserve wetlands moreover, a lack of emphasis on promoting a community participation in wetland conservation, along with barriers to land rights under Thai law in addition, controlling land use and buffer zones.

The researcher has recommendations such as 1) Propose to change the conservation goals of Thailand’s wetland, 2) Propose a secondary legislation to establish new rules for the conservation of wetlands, 3) Propose to define a definition of “Wetlands” and “Wise Use” are governed by Thai law, 4) Propose to apply measures from abroad to manage wetlands effectively, 5) Proposed to increase penalties for juristic person when offender is a representative of the juristic person, and 6) Propose to promote community in participation at all levels in wetland conservation, etc.
