Electronic Warranty and Consumer Protection in the Digital Age: A Comparative Legal Study between Thailand and the United States

Abstract

          This article aims to examine the legal framework concerning electronic warranties (e-warranties) and consumer protection in the context of the digital era. It focuses on issues arising from online transactions, where consumers often do not receive complete information regarding warranty terms—such as ambiguous language, hidden exclusions, or unjust limitations of liability imposed by businesses. The study analyzes relevant Thai laws, particularly the Direct Selling and Direct Marketing Act B.E. 2545 and the Consumer Protection Act B.E. 2522 and compares them with the legal framework of the United States, especially the E-Warranty Act of 2015, which establishes clear rules on the content, format, and disclosure of warranty information through electronic means. The comparative analysis reveals that Thai law lacks comprehensive provisions supporting the disclosure of warranty terms through digital platforms, which hinders consumers’ ability to effectively access their rights. Accordingly, the article proposes legislative reforms, the establishment of clear standards for electronic warranty content, and the development of mechanisms that allow consumers to access warranty information conveniently, transparently, and in a manner that ensures meaningful legal protection in the digital age.
