บทคัดย่อ
บทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาระดับการให้ความสำคัญและการใช้ประโยชน์พยานหลักฐานทางนิติวิทยาศาสตร์ในคดีอาญาเกี่ยวกับชีวิต ร่างกายและเพศ ของพนักงานสืบสวนสอบสวนในสังกัดตำรวจภูธรภาค 7 โดยมุ่งเน้นการพิจารณาเชิงวิเคราะห์ถึงระดับความเข้าใจ การตัดสินใจและการปฏิบัติงานของพนักงานสืบสวนสอบสวน ที่ส่งผลต่อประสิทธิภาพในการรวบรวม วิเคราะห์ และนำเสนอพยานหลักฐานทางนิติวิทยาศาสตร์ในกระบวนการยุติธรรมทางอาญา ผลการวิเคราะห์ชี้ให้เห็นว่า ปัญหาเชิงโครงสร้างที่สำคัญในการใช้ประโยชน์พยานหลักฐานทางนิติวิทยาศาสตร์ในคดีอาญาร้ายแรง ประกอบด้วย (1) ความแตกต่างของความรู้ ความเข้าใจและทักษะของพนักงานสืบสวนสอบสวนในการรักษาและตีความพยานหลักฐานทางวิทยาศาสตร์ (2) ข้อจำกัดด้านทรัพยากร เทคโนโลยีและงบประมาณที่ส่งผลต่อความน่าเชื่อถือของพยานหลักฐาน และ (3) ปัญหาในการนำเสนอพยานหลักฐานทางนิติวิทยาศาสตร์ต่อศาล ซึ่งอาจลดทอนน้ำหนักแห่งพยานหลักฐานและกระทบต่อความเชื่อมั่นของสังคมต่อกระบวนการยุติธรรม บทบาทของพนักงานสืบสวนสอบสวนเป็นปัจจัยสำคัญที่เชื่อมโยงระหว่างหลักฐานเชิงวิทยาศาสตร์กับการพิสูจน์ข้อเท็จจริงในทางคดี หากขาดความรู้ ความเข้าใจหรือแนวทางการปฏิบัติที่เป็นมาตรฐาน อาจนำไปสู่การใช้พยานหลักฐานอย่างไม่มีประสิทธิภาพและส่งผลต่อความเป็นธรรมในกระบวนการพิจารณาคดีอาญา ดังนั้น บทความจึงเสนอแนวทางเชิงนโยบายและเชิงปฏิบัติ ได้แก่ การพัฒนาระบบฝึกอบรมเฉพาะด้านนิติวิทยาศาสตร์อย่างต่อเนื่อง การส่งเสริมการทำงานแบบสหวิชาชีพ และการจัดสรรทรัพยากรด้านนิติวิทยาศาสตร์อย่างเพียงพอและทันสมัย เพื่อยกระดับมาตรฐานการใช้พยานหลักฐานทางนิติวิทยาศาสตร์ อันจะนำไปสู่ความถูกต้อง โปร่งใสและความเป็นธรรมในกระบวนการยุติธรรมทางอาญาในอนาคต
