บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาขั้นตอนการเดินทางเข้ามาในประเทศไทยของคนไทยสองสัญชาติ ปัญหา และอุปสรรคในการเข้ามาในราชอาณาจักร และเพื่อศึกษากฎหมาย ระเบียบ วิธีปฏิบัติของเจ้าพนักงานตรวจคนเข้าเมืองที่เกี่ยวข้องกับการเดินทางเข้ามาใน ราชอาณาจักรของคนสองสัญชาติโดยใช้วิธีการวิจัยเชิงคุณภาพ และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ ผลการศึกษาพบว่า การปฏิบัติของเจ้าพนักงานตรวจคนเข้าเมืองต่อคนไทยสองสัญชาติกรณีเดินทางเข้ามาในประเทศไทยด้วยหนังสือเดินทางต่างชาติในปัจจุบันต้องปฏิบัติเฉกเช่นคนต่างด้าวนั้นเป็นการกระทบสิทธิความเป็นคนไทยของคนสองสัญชาติ ส่งผลต่อระยะเวลาที่พำนักอยู่ในราชอาณาจักรกระทั่งกลับออกไปนอกราชอาณาจักร โดยจะถูกควบคุมตามกฎหมาย ทั้งการแจ้งการพักอาศัยการแจ้งรายงานตัวกับพนักงานเจ้าหน้าที่ตรวจคนเข้าเมืองทุกระยะเก้าสิบวัน รวมทั้งถูกดำเนินคดีหากอยู่เกินกำหนดอนุญาต เหล่านี้ล้วนเป็นการกระทบสิทธิความเป็นคนไทยที่เกิดจากการตีความบทกฎหมายและแนวทางปฏิบัติอย่างคลาดเคลื่อนของหลายภาคส่วนงานราชการ ทั้งเจ้าพนักงาน ตรวจคนเข้าเมืองและสถานเอกอัครราชทูตไทยและสถานกงสุลไทยในต่างประเทศจากผลการวิจัย เห็นควรให้สำนักงานตรวจคนเข้าเมืองพิจารณาแนวทางการปฏิบัติต่อคนไทยสองสัญชาติในฐานะเป็นคนไทย โดยให้การกำหนดแนวทางปฏิบัติและกฎหมายต้องไม่ขัดกัน ไม่กระทบสิทธิเสรีภาพความเป็นคนไทย และเสนอความเห็นควรให้มีการแก้ไขเพิ่มเติมกฎหมายเพื่อให้เกิดอำนาจในการดำเนินการปฏิบัติต่อคนสองสัญชาติอย่างเหมาะสม โดยเสนอให้แก้ไขเพิ่มเติมพระราชบัญญัติสัญชาติ พ.ศ. 2508 โดยเพิ่มเติมกฎหมายกำหนดให้ “บุคคลซึ่งมีสัญชาติไทยและถือสัญชาติอื่นด้วยมีหน้าที่แจ้งการมีสัญชาติอื่นนั้นแก่พนักงานเจ้าหน้าที่ตามแบบและวิธีการที่กำหนด” เพื่อเป็นบทบังคับให้เกิดการเก็บข้อมูลคนสองสัญชาติอย่างเป็นรูปธรรมต่อไป
