ปัจจัยความสำเร็จและปัญหาอุปสรรคในกระบวนการไกล่เกลี่ยในข้อพิพาทครอบครัวของศาลเยาวชนและครอบครัวจังหวัดสงขลา

บทคัดย่อ
การวิจัยครั้งนี้มีวัตุประสงค์ 3 ประการ คือ (1) เพื่อศึกษาถึงรูปแแบบความสำเร็จของการไกล่เกลี่ยข้อพิพาทของศาลเยาวชนและครอบครัวจังหวัดสงขลาและช่วยเพิ่มโอกาสแห่งความสำเร็จในการไกล่เกลี่ย
(2) เพื่อศึกษาถึงปัจจัย ปัญหา อุปสรรค และข้อเสนอแนะแนวทางในการพัฒนากระบวนการไกล่เกลี่ยในข้อพิพาทครอบครัวของศาลเยาวชนและครอบครัวจังหวัดสงขลา และ (3) เพื่อเสนอแนวทางที่เหมาะสมจากข้อค้นพบ วิธีการวิจัย ผู้วิจัยเก็บข้อมูลในงานวิจัยเชิงคุณภาพ โดยแบ่งออกเป็น 2 ส่วน ได้แก่ (1) การเก็บข้อมูลทุติยภูมิ และ (2) เก็บข้อมูลปฐมภูมิ โดยใช้ 2 วิธี ประกอบด้วยวิธีการสังเกตการณ์แบบไม่มีส่วนร่วมและการสัมภาษณ์แบบกึ่งโครงสร้าง
ผลการศึกษาพบว่า ปัจจัยที่มีผลต่อความสำเร็จการไกล่เกลี่ยข้อพิพาทของศาลเยาวชนและครอบครัวจังหวัดสงขลารวม 4 ปัจจัยที่ทำให้ประสบความสำเร็จการในการไกล่เกลี่ยข้อพิพาท ประกอบด้วย (1) ความคาดหวังและเป้าหมายในการเข้าสู่กระบวนการไกล่เกลี่ย (3) ปัจจัยด้านกระบวนการในการไกล่เกลี่ย ข้อพิพาท และ (4) ปัจจัยด้านอื่น ๆ ได้แก่ จำนวนทุนทรัพย์ บุคคลภายนอกที่เกี่ยวข้องกับคู่พิพาทในการเจรจาไกล่เกลี่ย
