Abstract
This article presents the idea about the fundamental rights of Böckenförde, anotable legal German scholar. I argue that Böckenförde proposed the idea of politicalsociety through three fundamental concepts including fundamental rights, state andconstitution. The fundamental rights are an importance concept of the constitutionalprinciple of Böckenförde which is the important idea of political society. In order toprove this argument, firstly, I examine the three fundamental thoughts of politicalsociety, fundamental rights, state and constitution. Finally, I intend to criticize onthe idea of fundamental rights of Böckenförde to demonstrate that the fundamentalrights are the most important idea of political society.
