บทความฉบับนี้ ประสงค์ที่จะทำการศึกษาบทบัญญัติของสหรัฐอเมริกา ว่าด้วยการกำหนดมาตรฐานวิชาชีพผู้ดูแลสุขภาพนักกีฬาในหลายมลรัฐ ผ่านกลไกการออกใบอนุญาตประกอบวิชาชีพผู้ดูแลสุขภาพนักกีฬา อีกทั้งยังมุ่งทำการศึกษาวิเคราะห์กฎหมายระดับมลรัฐของสหรัฐอเมริกา ซึ่งกำหนดหน้าที่ของผู้ดูแลสุขภาพนักกีฬา ที่จะต้องใช้ความระมัดระวังในการดูแลสุขภาพนักกีฬาอาชีพ หรือนักกีฬาสมัครเล่น ตามวิสัยของผู้มีความรู้ความสามารถในการประกอบวิชาชีพผู้ดูแลสุขภาพนักกีฬา พร้อมกับชี้ให้เห็นถึงประเด็นทางกฎหมายที่สำคัญ อันเกี่ยวกับความประมาทและทุรเวชปฏิบัติของผู้ดูแลสุขภาพนักกีฬาที่อาจเกิดขึ้นได้
บทความฉบับนี้ นำเสนอให้ผู้อ่านได้เห็นถึงสาระสำคัญของบทบัญญัติล่าสุดเกี่ยวกับมาตรฐานการออกใบอนุญาตผู้ดูแลสุขภาพนักกีฬาอาชีพ พร้อมกับทบทวนสาระสำคัญของกฎหมายระดับมลรัฐในสหรัฐอเมริกาที่เกี่ยวข้อง ซึ่งบทบัญญัติเหล่านี้เองได้วางหลักเกณฑ์กำหนดวิธีการ และกลไกเพื่อกำกับคุณภาพของการดูแลสุขภาพนักกีฬาและสร้างมาตรฐานวิชาชีพผู้ดูแลสุขภาพนักกีฬา
ผลการศึกษาในครั้งนี้ ควรนำไปสู่ข้อสรุปที่ว่าประเทศไทยน่าจะพัฒนาเกณฑ์เฉพาะสำหรับสร้างมาตรฐานการปฏิบัติงานของผู้ดูแลสุขภาพนักกีฬาได้ในอนาคต โดยจะกำหนดเกณฑ์เฉพาะสำหรับผู้ดูแลสุขภาพนักกีฬาที่ไม่เพียงแค่จะต้องปฏิบัติหน้าที่อันใช้ทักษะในการดูแลสุขภาพนักกีฬาที่หลากหลายเท่านั้น หากแต่เกณฑ์เฉพาะดังกล่าวอาจถูกใช้เป็นเครื่องมือในการสร้างมาตรฐานการดูแลสุขภาพนักกีฬาที่เหมาะสมในอนาคต อีกด้วย
