Abstract
Drafting the Constitution of the Kingdom of Thailand, B.E. 2560 (2017) contained therein reflecting the importance of the drafting process of the constitution contents and the firm relationship among political institutions related to the legislative power and the executive power, The key elements of the parliamentary system, under the constitution examination process in a democratic country, shall have the doctrine of separation of powers. The regulations on right, liberty and state power under the Constitution of the Kingdom of Thailand, B.E. 2560 have stipulated the constitution drafting framework. the constitution contains matters of fact and subjects in another law system has been included into the Parliamentary System as well as subjectsonly existed in the Presidential System. These issues affect the doctrine of separation of powers, it means it fails to conform with Thailand social context.
This article on some observations on the Constitution of The Kingdom of Thailand, B.E. 2560 (2017) focuses on enriching understanding of the drafting process of the Constitution of the Kingdom of Thailand, B.E. 2560 and certain contents which should be contained in the constitution which shall conform with the Parliamentary System as the same subject.
