Abstract

Thai lawyers accept that the meaning and characteristic of law refer to “an order of sovereignty regardless of constitutional or unconstitu tional way. The constitution issues law in order to rule the country. In case of breaching the law, the punishment will be imposed.” According to the positive law concept, the positive law has higher prestige than the Natural Law and supports the leader’s power rather than the acceptance and assurance of people’s liberty and rights as well as giving precedence to the rights of holding power rather than the liberty and rights of people as the owner of true sovereign power. It results in the government’s law as an instrument for controlling people is juts an element of political system. It becomes an obstacle for the democracy of Thailand in the present and the future.
