Legal Issues in Enforcement of Health Establishment Act, B.E. 2559 (2016)

Abstract

This academic paper aims to study the laws concerning health care facilities. The health establishment business is a service business that makes jobs and generates large income. This type of business has been trusted by both Thai and foreign customers for a long time. At present, the Health Establishment Act, B.E. 2559 (2016) is the main law regulating the business particularly.

According to the study, it was found that operators, especially massage and spa business owners, still lacked understanding of certain laws. In this article, the research studied the survey of business owners on knowledge and understanding and analyzed the actual law enforcement. The study also included the comparison of foreign laws to apply the gained knowledge to review the applicable laws.

The study found that the definition was ambiguous. Certain types of businesses were not covered by the law. Therefore, the definitions under the Health Establishment Act, B.E. 2559 (2016) should be revised
