Legal Measures for Remedy for People Affected by Dust Pollution

The purpose of this research paper is to study the legal measures for remedy for people affected by dust pollution including dust particles less than 2.5 micrometers in diameter (PM2.5) in Thailand. Generally, the right to a good environment and the right to clean air are regarded the fundamental right of human being. Sufferers and people affected by dust pollution have the right to remedy, the fundamental right to prevent the human rights violations, from any activities causing air pollution and health hazards. Those affected by dust pollution must receive the concrete environmental justice.
The author found that the environmental damage was different from general tortious act. Remedy for tort under the Civil and Commercial Code was a remedy for the rights of individuals. Such remedy was not applicable to victims of environmental tort suitably.
The author suggests the following solutions. The government should enact the environmental tort laws directly to ensure victim receives appropriate and fair remedies as well as encouraging the private sector to monitor the government agencies’ action closely. People should have the channel to sue any negligent government agencies for their failure to perform the environmental protection even the suer is not regarded a direct victim. The government should stipulate the civil, administrative and remedial measure in accordance with the principle of liability without fault in case of the environmental damage affecting the public.
