An Analysis of the Exercise of Social Security Rights in the Case of Medical Treatment among member states of the Association of Southeast Asian Nations Under the Legal Practice

Abstract

This analysis journal has a purpose to study Social Security Rights which is basic rights of labour as human rights under The International Labour Organization Convention. It typically aims to study social security rights of the insured in case of medical treatment under the law enforced among member states of the association of Southeast Asian Nations by comparing to European Community, European Union, Kingdom of Norway, and the French Republic divided into 4 parts 1. What are social security rights 2. The ways to exercise the rights 3. Subsidy collection and 4. Reclamation of benefits from the states exercising the rights. After studying it all, member states of the association of Southeast Asian Nations can bring all of the knowledge above into a model to develop all of the member states to have agreements, cooperation, and treaties related to the exercise of social security rights in case of medical treatment among their own member states.

The study found that member states of the association of Southeast Asian Nations have not allowed migrant workers to exercise social security rights in case of medical treatment in the member states in which skilled workers and professional workers moved to work. Although the association of Southeast Asian Nations established ASEAN Economic Community and it led to the ASEAN framework on agreement of services and mutual recognition arrangement, they have never legislated the law for skilled workers and professional workers moving to the states to support their exercise of social security rights in case of medical treatment.

 Therefore, in order to protect the rights of migrant workers who move to member states of the association of Southeast Asian Nations, the member states who are ready to receive migrant workers to work in their states and ready to allow migrant workers to exercise social security rights in case of medical treatment should make agreements, cooperation, and treaties by dividing it into 2 phrases. In the beginning, agreements, cooperation, and bilateral treaties are required. After that, it shall be common agreements to enforce to all member states
