ปัจจัยที่มีผลต่อความสำเร็จของการไกล่เกลี่ยข้อพิพาทในชุมชน กรณีศึกษา ศูนย์ยุติธรรมชุมชนตำบลโคกขาม อำเภอเมือง จังหวัดสมุทรสาคร

บทคัดย่อ

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อสำรวจปัจจัยที่มีผลต่อความสำเร็จของการไกล่เกลี่ยข้อพิพาทในชุมชน โดยใช้ศูนย์ยุติธรรมชุมชนตำบลโคกขาม อำเภอเมือง จังหวัดสมุทรสาครเป็นกรณีศึกษา การวิจัยเชิงคุณภาพชิ้นนี้ รวบรวมข้อมูลจากการสัมภาษณ์เชิงลึกของผู้ให้ข้อมูลที่สำคัญ จำนวนทั้งสิ้น 12 คน ประกอบกับการศึกษาข้อมูลจากเอกสาร และการวิเคราะห์ข้อมูลเชิงเนื้อหา ผลการวิจัยพบว่า ผู้ให้ข้อมูลที่สำคัญทั้งหมดได้ให้ข้อมูลอย่างสอดคล้องต้องกันว่า ผู้ทำหน้าที่ไกล่เกลี่ยข้อพิพาทมีความรู้เพียงพอในการปฏิบัติหน้าที่ มีความเป็นกลาง และไม่เข้าข้างฝ่ายหนึ่งฝ่ายใดในการไกล่เกลี่ยข้อพิพาท ในกรณีที่ผู้ไกล่เกลี่ยข้อพิพาทเป็นบุคคลที่คู่กรณีที่มีข้อพิพาทให้ความเคารพนับถือหรือเป็นบุคคลที่มีความรู้ความสามารถที่เป็นตัวแทนของหน่วยงานภาครัฐเข้าร่วมในการไกล่เกลี่ยข้อพิพาทด้วย การไกล่เกลี่ยข้อพิพาทนั้นๆ จะยุติลงได้อย่างรวดเร็ว นอกจากนี้ปัจจัยที่มีผลต่อความสำเร็จของการไกล่เกลี่ยข้อพิพาทในชุมชนแห่งนี้ยังประกอบด้วย บทบาทของอาสาสมัครที่ทำหน้าที่ไกล่เกลี่ยข้อพิพาทซึ่งมีความรู้และความชำนาญ ในเรื่องที่ดำเนินการไกล่เกลี่ยข้อพิพาท ศูนย์ยุติธรรมชุมชนมีการประชาสัมพันธ์ให้ความรู้และคำแนะนำแก่คนในท้องถิ่น นอกจากนั้น ศูนย์ยุติธรรมชุมชนตำบลโคกขามยังมีสถานที่ตั้งในระยะทางที่เหมาะสม การเดินทางสะดวก หาง่าย เพราะเป็นศูนย์กลางของประชาชน และมีบุคลากรที่ปฏิบัติงานอย่างเพียงพอ อย่างไรก็ตาม การดำเนินงานของศูนย์ยุติธรรมชุมชนตำบลโคกขามควรได้รับการจัดสรรเงินงบประมาณในการดำเนินการจากหน่วยงานต่างๆ ของภาครัฐให้มากขึ้น

Factors Contributing to the Success of the Community Mediation : A Case Study of Khok Kham District Community Justice Center, Mueang District, Samutsakhon Province.

The objectives of this research were to explore factors of the success of mediation in a community, with Khok Kham District Community Justice Center, Mueang District, Samut Sakhon Province as a case study. To conduct the research, qualitative approach was applied in acquiring the data from in-depth interviews with 12 key-informants and literature review. Data analysis was done by content analysis. Research results showed that all key informants reported that mediators had sufficient knowledge, were neutral, and did not give any party a favor in the dispute. In the case that the mediators themselves were respected by the parties to the dispute, or knowledgeable in various aspects of government agencies involved in the dispute, such dispute would end very quickly Moreover, factors contributing to the success of mediation in this community included the role of the volunteers who mediated the dispute with knowledge and expertise in the matter under dispute, the Community Justice Center had publicized the knowledge and advise to local people. Moreover, the Khok Kham District Community Justice Center was conveniently located, and was easy to find because it is the center of the public. This Community Justice Center also had adequate number of personnel. However, the Khok Kham Community Justice Center should be allocated with a larger budget from the relevant government agencies.
